The Merchant shall not allow any user, customer, subscriber, creator, content provider or other third party to upload, submit, publish, transmit, store, share or otherwise provide any image, video, audio, text, file, personal photograph, identification document, biometric data, voice sample, face image, or any other content to the Merchant’s website, platform, application or service.

The Merchant confirms that all adult content available on the Merchant’s platform is generated, controlled, moderated and made available solely through the Merchant’s own platform environment, and that no user-generated content, creator-uploaded content, or third-party uploaded content is permitted.

The Merchant shall not allow its platform to generate, display, distribute, promote or make available any adult content that depicts, imitates, resembles, impersonates or is intended to represent a real person, including but not limited to celebrities, public figures, influencers, private individuals, former partners, customers, employees, or any identifiable person.

The Merchant shall prohibit the use of any real person’s name, image, likeness, voice, biometric characteristics, personal identity, social media profile, or other identifying features in connection with adult content generation.

The Merchant shall not generate, host, display, distribute, advertise, promote, sell, or otherwise make available any content that is illegal or otherwise violates applicable law, card scheme rules, acquirer requirements, or industry standards.

The following content is strictly prohibited:

1. Any content involving, depicting, suggesting, implying or sexualizing minors or persons who appear to be minors;
2. Any child sexual abuse material or child exploitation material, whether real, synthetic, animated, AI-generated or fictional;
3. Any non-consensual sexual content, including rape, coercion, forced sexual acts, intoxication, unconsciousness, blackmail or inability to consent;
4. Any deepfake, face-swap, image manipulation or synthetic adult content involving a real or identifiable person without explicit authorization;
5. Any content involving human trafficking, sex trafficking, slavery, exploitation, abduction or physical abuse;
6. Any content involving violence, torture, extreme abuse, bestiality, incest, necrophilia, or other unlawful or prohibited sexual content;
7. Any content that promotes, facilitates or normalizes illegal sexual conduct;
8. Any content that violates privacy, publicity rights, intellectual property rights, or other personal rights of any third party.

The Merchant shall implement and maintain effective age-gating controls to prevent minors from accessing adult content or services.

The Merchant shall ensure that users are required to confirm that they are legally permitted to access adult content in their jurisdiction. Where required by applicable law, the Merchant shall implement enhanced age verification measures.

The Merchant shall not market, promote, or otherwise make adult content available to minors.

The Merchant shall implement reasonable and effective controls to prevent users from generating prohibited content through prompts, keywords, descriptions, roleplay settings, character profiles or other inputs.

The Merchant shall maintain appropriate moderation measures, including but not limited to:

1. Prohibited keyword filtering;
2. Prompt-level risk detection;
3. Output-level image, video, text or audio moderation;
4. Blocking of attempts to generate minor-related or non-consensual sexual content;
5. Blocking of attempts to generate adult content involving real persons or public figures;
6. Manual review or escalation for high-risk cases;
7. Suspension or termination of users who attempt to bypass content controls.

The Merchant shall not market, advertise, tag, categorize, describe, optimize, promote or otherwise present its website or services in a manner that suggests or implies the availability of illegal, non-consensual, abusive, exploitative, minor-related, trafficking-related or otherwise prohibited adult content.

The Merchant shall not use prohibited terms, search terms, keywords, metadata, SEO terms, advertisements, thumbnails, titles or descriptions that imply child exploitation, non-consensual acts, coercion, abuse, trafficking or other illegal adult content.

The Merchant shall maintain a clear, accessible and effective complaint and takedown process that allows users, depicted persons, rights holders, regulators, acquirers, card schemes or other affected parties to report content that may be illegal, unauthorized, non-consensual or otherwise prohibited.

The Merchant shall review and resolve reported complaints within seven business days. Where a complaint indicates potential illegal content, non-consensual content, minor-related content, or other serious violation, the Merchant shall remove or disable access to such content immediately pending further review.

The Merchant shall provide a mechanism for any person who claims to be depicted, referenced, impersonated or otherwise affected by adult content on the Merchant’s platform to request removal of such content.

If the Merchant cannot establish that the content is lawful, authorized and compliant with applicable requirements, the Merchant shall remove the content with immediate effect.

For AI-generated content, the Merchant shall not reject a removal request solely on the basis that the content is synthetic, fictional, AI-generated or not based on an actual recording.

The Merchant shall maintain records of:

1. User complaints;
2. Takedown requests;
3. Content moderation decisions;
4. Blocked or rejected prompts;
5. Removed content;
6. Suspended or terminated users;
7. Any suspected illegal or prohibited content incidents.

The Merchant shall provide such records, reports, explanations or supporting documentation to the acquirer, payment service provider, card scheme or relevant regulator upon request.

Where required by the acquirer, the Merchant shall provide monthly reports covering flagged content, complaints, takedown requests, actions taken and relevant URLs or content identifiers.

The Merchant shall maintain full control over its website, application, AI content generation system, content moderation process, user access controls and payment-related user journey.

Upon request, the Merchant shall provide temporary access credentials to the acquirer or card scheme for the purpose of reviewing website content, restricted content, paywalled areas, user flows and compliance controls.

The Merchant shall maintain and enforce policies prohibiting the use of its platform in any manner that promotes, facilitates or is connected to human trafficking, sex trafficking, child exploitation, coercion, abuse or unlawful sexual conduct.

The Merchant shall promptly investigate and escalate any suspected violation and cooperate with the acquirer, payment service provider, card scheme, regulator or law enforcement authority where required.

The Merchant acknowledges that any breach of these Adult AI Content Compliance Terms may result in immediate suspension or termination of payment processing services, withholding of settlement, enhanced monitoring, reporting to card schemes, or other actions required by the acquirer, payment service provider or applicable card scheme rules.
